1. Introduction and Acceptance of Terms
Welcome to The Burm™ website. These Terms and Conditions (“Terms”) govern your access to and use of the website and services operated by The Burm Media Group Limited (“The Burm™”, “we”, “us” or “our”). The Burm Media Group Limited is a company based in the United Kingdom. By accessing, browsing, or using our website (the “Site”), you confirm that you have read, understood, and agree to be bound by these Terms, together with any other policies referenced herein (such as our Privacy Policy and Cookie Policy). If you do not agree with these Terms, you must not use the Site.
The term “you” refers to any individual or entity using our Site. You should read these Terms carefully. We recommend that you print or save a copy for your records. These Terms apply to all visitors, users, and others who access the Site or any of our services. If you have any questions about these Terms, please contact us using the information in the “Contact Information” section below.
2. Description of Services and Scope
The Burm™ is a website dedicated to BMX racing and related content. Our services include, but are not limited to, providing BMX-related news and articles, publishing race results from BMX events, sharing photographs and media from races (including images of participants), maintaining custom BMX rankings and other statistics, and offering general information about BMX racing. From time to time, our Site may also feature sponsored content or product reviews, and in the future we plan to include an online shop for BMX-related merchandise (hosted via a third-party platform, as described later in these Terms).
All content and services provided through our Site are for general information, enjoyment, and community purposes. We strive to ensure the content is accurate and up-to-date, but it is provided on an “as is” basis (see Limitation of Liability below). The scope of our services may evolve over time. We reserve the right to add, remove, or change any features or content on our Site at our discretion and without prior notice, provided that such changes do not retroactively alter the terms for any paid services or transactions already completed.
Please note that our Site may contain links to third-party websites or services (for example, links to event organizer pages, social media, or affiliate partner sites). These third-party services are outside the scope of The Burm™’s control and are governed by their own terms and policies (see Sponsored Content and Affiliate Links and Advertising, Cookies, and Third-Party Tools below for more information). Using our Site does not create any contractual relationship between you and any of our partners or affiliates, other than as explicitly provided in these Terms.
3. User Rights and Responsibilities
We grant users a limited, non-exclusive, non-transferable license to access and use our Site and its content for personal, non-commercial purposes, subject to your compliance with these Terms. This means you may view, share links to, and engage with our content for your own information and enjoyment. However, certain rules apply to ensure a safe and lawful experience for all users:

(Note: If our Site in the future allows commenting or user submissions, all users must interact respectfully and refrain from abusive language.)

Unauthorized Access: Attempt to gain unauthorized access to any portion of the Site, server, or any related system or network, or to any other user’s account or information (if user accounts are provided).

Commercial Exploitation: Use the Site or its content for any commercial purpose not expressly permitted by us. This means you should not scrape, data-mine, reproduce, sell, or exploit any portion of our Site or content for commercial gain without our prior written consent.

Impersonation or Misrepresentation: Impersonate The Burm™ or our staff, or falsely imply that you are associated with us, or any other person or entity. You must not use The Burm™’s name, logo, or branding in a way that could mislead others into believing you are officially affiliated or endorsed.
3.2. User Accounts (if applicable): Currently, our Site may not require creating an account for general browsing. However, if in the future we offer account registration (for example, to comment on articles, sign up for newsletters, or make purchases), you agree to provide accurate and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of any login credentials, and for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately. We will not be liable for any loss or damage arising from your failure to safeguard your account information.
3.3. Suspension or Termination: We reserve the right to suspend or terminate your access to the Site (or certain features of it) at any time, without notice, if, in our reasonable opinion, you violate any provision of these Terms or misuse the Site. We also reserve the right to remove or edit any content or material (for example, a user comment) that we find to violate these Terms or to be otherwise objectionable, at our discretion.
By using our Site, you are also responsible for ensuring that any persons who access our Site through your internet connection are aware of and comply with these Terms. Failure to comply with the User Responsibilities outlined in this section constitutes a serious breach of these Terms and may result in us taking all or any of the following actions: immediate, temporary, or permanent withdrawal of your right to use our Site; legal proceedings against you for reimbursement of all costs on an indemnity basis resulting from the breach; further legal action; or disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
4. Publishing Race Results and Photographs (Including Children’s Data)
One of The Burm™’s key services is publishing BMX race results and photographs from events, which can include personal data of participants, including minors (children under 18 years old). We take the privacy and data protection of all individuals, especially children, very seriously. This section explains how and why we publish such information and the lawful basis for doing so in compliance with UK data protection laws (including the UK General Data Protection Regulation – “UK GDPR” – and the Data Protection Act 2018).
4.1. Nature of Published Data: The race results we publish typically include information such as participants’ names, age categories or competition classes, race placements (rankings/finishing positions), team or club affiliation (if relevant), and possibly other performance information from the event. Photographs or videos taken at events may depict participants during races, on the podium, or in other event settings. These photos might include identifying images of both adult and minor athletes (for example, showing their face and racing jersey number).
4.2. Lawful Basis for Processing: The Burm™ processes and publishes this personal data on the following lawful bases:

Legitimate Interests: We have a legitimate interest in reporting on and promoting BMX racing events, as a part of our mission to support the BMX community and provide sports journalism content. Publishing race results and event photography is a standard and expected aspect of sports events coverage. We have carefully assessed that this interest is not overridden by the rights and freedoms of the individuals (including child participants), especially since participants in BMX races (and their parents/guardians, in the case of minors) generally expect that results and photos from public events will be published. We limit the data we publish to what is relevant and necessary for reporting (e.g. name, placement, and image from the event) and we use it in a sports journalism context, which the UK GDPR recognizes can fall under freedom of expression and information considerations.

Consent via Event Organisers: In many cases, event organisers or race hosts obtain consent from participants (or from parents/guardians for minors) as part of the event registration process, permitting the use of race results and photographs for publicity and reporting. The Burm™ often works closely with event organisers and relies on the representations from those organisers that appropriate consents have been obtained. Where such consent has been collected by the organisers, we treat that as a lawful basis for us to publish the provided results and images from the event.
By participating in BMX racing events and competitions, adult competitors and the parents or guardians of junior competitors generally acknowledge that publication of results and images is a foreseeable part of the sport. However, we understand that individual circumstances may vary and we are committed to respecting data subject rights.
4.3. Safeguards for Minors’ Data: When publishing content that involves children, we implement additional caution in line with data protection principles. We do not include unnecessary personal details about minors beyond what is normally needed for sports reporting. For example, we typically will not publish a child’s full date of birth, contact details, or any private information – only their name, age category, and race result as relevant. Photographs of minors are chosen carefully to reflect positive, appropriate moments in the sporting context. If an organiser or a parent/guardian has expressly informed us that a particular child should not be identified or photographed, we will honor that request whenever we are made aware.
4.4. Your Rights and Options: If you (or your child) are featured in a race result or photograph on our Site and you have concerns about this, you have rights under data protection law. In particular, you may have the right to object to the processing (if we rely on legitimate interests) or to withdraw consent (if consent was the basis) and to request removal or anonymization of the data. If you wish to request that a result or photo be taken down or modified, please contact us (see Contact Information below). We will review and address such requests in accordance with applicable laws. Generally, if removal is requested by a participant (or a minor’s parent/guardian) on valid grounds, The Burm™ will endeavor to remove or obscure the person’s name or image in our published content, unless we have an overriding legitimate ground to continue processing (in which case we will inform you of that decision and your options).
Please be aware that once photographs or results are published on our Site, they may be seen and possibly reused by members of the public or other media (for example, shared on social media or archived by sports organizations). The Burm™ cannot control third-party actions, but we do ask that anyone using our content respects the privacy of individuals, especially children. For more information on how we handle personal data and your rights, please review our Privacy Policy. By using our Site and viewing the race results and photographs we publish, you agree that you understand our lawful bases for this content and that we handle such data in compliance with UK data protection requirements.
5. Intellectual Property Rights
All content and materials on The Burm™ website are protected by intellectual property laws and are owned by The Burm Media Group Limited or used under license. This includes (but is not limited to) the text, articles, blog posts, graphics, photographs, videos, race results data, custom BMX rankings, logos, designs, site layout, and any software or code underpinning the Site (collectively, the “Content”).
5.1. Ownership: Unless otherwise indicated, The Burm Group Limited retains full ownership and rights (including copyright and database rights) in the Content that we create or compile. For example, any rankings or statistical compilations we produce are our original work and protected as our intellectual property. Likewise, our brand name “The Burm™” and our logos are trademarks or trade names owned by The Burm Media Group Limited. All rights are expressly reserved.
Some content on our Site may be contributed by third parties – for instance, photographs taken by freelance photographers or race results provided by event organisers. Such content is published by us with permission and/or under license. The intellectual property rights in those contributions remain with their respective owners (e.g. the photographer or organiser), but by providing them to us they have granted The Burm™ the right to display and share that content on our Site. Whether content is owned by us or by a third-party contributor, you are not granted any rights to it beyond the limited personal use license described below.
5.2. Permitted Use of Our Content: You may access and view Content from our Site on your personal device, and you may print or download extracts for your own personal and non-commercial use (for example, saving a copy of an article or a race result for personal records, or sharing a photo of yourself from a race with family). You are also welcome to share links to our Site or our articles on social media or with others, which we actually encourage as it helps promote BMX racing. If you do share our content or discuss it elsewhere, we ask that you give appropriate credit to The Burm™ (for example, by linking back to the original page or mentioning our name).
5.3. Prohibited Use of Content: Except as expressly permitted by these Terms or by applicable law, you must not use any Content from our Site in other ways without our prior written consent. This means you are not allowed to:

Copy, reproduce, or distribute our Content in full (such as republishing an entire article or photo on your own website or in print) without permission.

If you wish to make any use of Content from our Site beyond what is permitted here (for example, a sports club wanting to reproduce an article or a media outlet wanting to use our photos), please contact us to request permission. We may grant permission or licenses on a case-by-case basis and may require attribution, a licensing fee, or other conditions.
5.4. User-Generated Content: (If applicable) In the event our Site allows you to submit or upload content (such as comments, forum posts, or contributing articles or photos), any content that you submit will remain your property, but by submitting it you grant The Burm Media Group Limited a worldwide, royalty-free, perpetual license to use, display, reproduce, distribute, and adapt your content on our Site or in connection with our services. For example, if you comment on a blog post, we have the right to display that comment to other users; or if you submit a guest article or photo, we may edit and publish it. You are responsible that any content you submit does not infringe anyone else’s rights and is lawful. 5.5. Intellectual Property Complaints: We respect the intellectual property rights of others and expect our users to do the same. In summary, all Site content is protected. Your use of the Site must respect our and our licensors’ intellectual property. No ownership or rights are transferred to you by virtue of using our Site. Unauthorized use of our Content may result in civil or criminal penalties.

7. E-Commerce and Third-Party Platform Transactions
The Burm™ plans to offer an online shop for BMX-related merchandise in the future. This shop may be hosted and facilitated through a third-party e-commerce platform, such as Shopify, which allows us to list products and handle transactions securely. This section outlines how transactions will be handled and our respective responsibilities, even if you have not yet used the shop feature (we include it here so you’re aware in advance).
7.1. Third-Party E-Commerce Platform: When our shop is launched, it might be accessible via a subdomain or link that directs you to a storefront operated on the Shopify platform (or a similar e-commerce service provider). While the look and branding will indicate you are purchasing from The Burm™, the underlying platform is provided by a third party. This means:

The platform (e.g., Shopify) will manage certain technical aspects of your purchase, such as the shopping cart, checkout process, and payment processing. You may be required to agree to the platform’s own terms of service and/or privacy policy when making a purchase (usually presented at checkout). These are in addition to The Burm™’s own Terms and policies.

The Burm™ does not see or hold your full payment card details; we receive confirmation of payment and the necessary information to fulfill your order (e.g., your name, contact info, shipping address, and what you ordered).
7.2. Product Information and Pricing: We will endeavor to ensure that all products listed in our online shop are described accurately and priced correctly. However, mistakes can occur (for example, a typo in a price or an out-of-date stock indicator). The Burm™ reserves the right to correct any errors in pricing or descriptions, and to cancel or refuse orders placed for products listed at an incorrect price. If we have to cancel an order after you’ve been charged (for instance, due to a pricing error or stock issue), we will notify you and provide a full refund via the original payment method.
Prices for products will be listed in the appropriate currency (likely GBP for UK) and include or exclude VAT as stated (we will make it clear if prices include VAT). Additional charges such as shipping or handling will be shown at checkout before you finalize your order.
7.3. Orders and Contracts: When you place an order through our online shop, you will be required to provide certain information (like your name, shipping address, email, and payment details). You must ensure this information is accurate. After you place an order, you should receive an order confirmation (on-screen and/or via email). This confirmation is an acknowledgment that we received your order. The actual contract of sale is formed when we dispatch the product to you and send a confirmation of dispatch. We reserve the right to decline or cancel orders at our discretion, for example if a product is unavailable, if we suspect fraud, or if you are in a country we do not ship to. If an order is canceled and you have been charged, we will refund you.
7.4. Fulfillment and Third-Party Services: The Burm™ will be responsible for fulfilling the orders (e.g., packaging and shipping the merchandise to you) unless stated otherwise. We might use third-party fulfillment services or suppliers for certain products. Any estimated delivery times we provide are just estimates; actual delivery times may vary. We will do our best to meet indicated dispatch and delivery times, but we are not liable for delays caused by third-party couriers or unforeseen issues (like postal strikes or customs delays).
7.5. Returns and Consumer Rights: If you purchase goods from our future shop, your purchase will be covered by applicable consumer protection laws, including the Consumer Rights Act 2015 and distance selling regulations in the UK. This typically includes your legal right to return items bought online within 14 days of receipt for a refund (with some exceptions, e.g., for certain perishable or personalized items), and your right to receive goods that are as described, of satisfactory quality, and fit for purpose. We will have a Returns/Refund policy available on the shop page that gives details on how to return an item and any specific conditions. In case of any conflict between those specific sale terms and these general Terms, the specific sale terms (and your statutory rights) will take precedence for the transaction.
The Burm™ disclaims any additional warranties beyond those required by law. We will, however, honor all legal obligations for faulty or misdescribed products. If you have an issue with a product you bought (e.g., it arrives damaged or not as described), please contact us and we will work to resolve it by offering a repair, replacement, or refund as appropriate.
7.6. Liability for E-Commerce: While we will do our best to ensure a smooth shopping experience, there are certain things we cannot guarantee or be responsible for, especially because a third-party platform is involved. To the fullest extent permitted by law:

The Burm™ will not be liable for any losses resulting from the unavailability of the third-party e-commerce platform or any technical errors during the checkout process that are outside our control. (For example, if the Shopify platform has an outage or a payment gateway is down, resulting in you not being able to place an order.)

The Burm™ is not responsible for any security breaches or data leaks that occur on the third-party platform’s systems. (For instance, if Shopify or the payment processor were compromised – note that these platforms are highly secure and such events are rare, but we must mention it.) We rely on the platform’s security measures to protect your transaction.

Any dispute related to payment (such as a billing error or payment fraud) may involve the third-party payment processor. We will support you in resolving such issues to the extent we can, but some issues might need to be addressed by your bank or the payment provider.
However, none of the above affects The Burm™’s liability for our own obligations in fulfilling your order or our responsibility to deliver the products you purchased. We just want to clarify that for aspects of the transaction that are handled by third-party systems, our liability is limited. Of course, nothing in these Terms limits your rights under law or any liability that cannot be limited by law (see Limitation of Liability below for more on general liability limitations).

8. Sponsored Content and Affiliate Links
The Burm™ may at times feature sponsored content or affiliate links as part of our website content. We believe in transparency and want you to understand what this means:

We strive to ensure that sponsored articles still provide value to our readers and remain relevant to BMX or the interests of our audience. Even though a sponsor has input, we aim to maintain honesty and fairness in any content. Any opinions or views expressed in sponsored content will be either clearly those of the sponsor or our genuine opinions (we won’t say something is great if we truly don’t believe it, for example, in a product review).

Sponsored content does not mean The Burm™ endorses the sponsor’s products or services beyond what is explicitly stated. We are careful about the partners we work with, but we do not make guarantees on behalf of any sponsor. Any reliance you place on sponsored information is at your own risk, and you should always use your own judgment and perhaps further research when considering any product or service mentioned.
8.2. Affiliate Links: An affiliate link is a special URL that tracks referrals from our Site to an external retailer or service. If you click on an affiliate link on The Burm™ and then make a purchase on the external site, The Burm™ may receive a small commission or referral fee from that purchase (at no additional cost to you). 10. Governing Law and Dispute Resolution
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or with your use of the Site shall be governed by and construed in accordance with the laws of England and Wales. We choose English law because The Burm Media Group Limited is based in the UK (England) and we wish to have a consistent legal framework.
If you are a consumer located outside of England and Wales, you may also be entitled to the protection of the mandatory consumer protection laws in your country of residence. However, to the extent permissible, we do not voluntarily submit to the laws of any jurisdiction other than England and Wales for the purposes of these Terms.

This means that if you wish to bring a legal claim against us, it must be in the courts located in England or Wales (subject to any rights you might have as a consumer to also bring an action in your home country). 11.3. No Third-Party Rights: These Terms are an agreement between you and The Burm Media Group Limited. No other person shall have any rights to enforce any of these Terms. In particular, the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms – meaning that no third party (other than someone we validly transfer our rights to, as explained next) can claim any benefit or enforce any provision of these Terms. (For example, even if you read our site content on behalf of a friend, that friend has no contractual claim under these Terms – it is only between you and us.)
11.4.
